Getting your money’s worth from the commission you pay: What you think you are getting when you pay a commission to an agent to represent you isn’t always what you get. For many agents in the commercial real estate industry, it has become all to easy for them to put their personal interests ahead of their clients’. Some agents have a history of buying properties on their own or with buyers for which they were paid by the seller. Others make a practice of putting up barriers to cooperation with other agents to limit competition with their own buyers. Some agents even insist on agreements with their preferred buyers: if they squeeze out a “good deal” for that buyer, the buyer will re-list the property with the agent when he/she flips if for a profit.

Getting expert guidance, quality information and, fair dealing and good faith: Any broker can show you a property to buy. The problem is that buyers are often presented with limited and/or inaccurate information. It is also common to be sold on properties which are not deliverable or which have easily identifiable, undisclosed challenges which go undiscovered until after a buyer has wasted valuable time during the inspection period. Not having proper, informed and honest guidance from an experienced agent can not only be a time waster, it can be costly. The risks are especially high for 1031 exchange buyers who have no room for error with timing to identify and close on upleg purchases.
